Terms of Use

These terms are the agreement between you and Plug & Play Productions (“we”, “us”) for your use of the ApneaStudio app. By using the app you accept them. Please read the safety section carefully.

Safety — read this first

Freediving and breath-hold training are dangerous and can cause blackout, shallow-water blackout, injury or death, even for experienced and healthy people. Never practise breath holds in or near water alone. Always train with a trained partner able to rescue you. ApneaStudio is a tool for planning and recording training. Its timers, tables and numbers are guides, not a safety system, and they will not keep you safe. You are responsible for training within your limits and following proper safety practice and qualified instruction.

What ApneaStudio is

ApneaStudio helps you structure, run and track freediving and apnea training. It is not a substitute for certified freediving instruction, a coach, a dive buddy, or medical advice. It does not teach you to freedive, and it does not assess whether any hold, table or dive is safe for you. Consult a doctor before starting breath-hold training, particularly if you have any heart, lung, blood-pressure or neurological condition, or if you are pregnant.

Training and certification

ApneaStudio is intended for people who have completed recognised freediving or apnea training with a qualified instructor. We strongly recommend that you hold a current freediving certification and understand safe breath-hold and rescue practice before using the app.

You use ApneaStudio, and undertake any training you plan or record with it, entirely at your own risk and on your own judgement. You confirm that you understand the dangers of breath-hold training, that you accept full responsibility for training safely, within your ability, and with appropriate supervision, and that we are not responsible for how you choose to train.

Your account

You are responsible for your account and for keeping your sign-in secure. Provide accurate information and keep it up to date. You must be at least 18 to use the app.

Subscription and billing

Acceptable use

Use ApneaStudio only for your own personal training. Do not copy, resell, reverse-engineer or misuse the app, or use it in any unlawful way.

Licence

We grant you a personal, non-transferable, non-exclusive licence to use ApneaStudio on Apple devices you own or control, in line with these terms and Apple’s rules. We own the app and its content.

Limitation of liability

To the fullest extent permitted by law, we are not liable for any injury, loss or damage arising from your use of ApneaStudio or from any freediving, breath-hold or other training, whether or not planned or recorded with the app. Nothing in these terms limits any liability that cannot be limited by law, including for death or personal injury caused by our negligence.

Apple

Apple is not a party to these terms and is not responsible for the app. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them. Any app-related maintenance, support or warranty claims are our responsibility, not Apple’s, to the extent required by law.

Changes and ending

We may update these terms; the date above shows the latest version, and continued use means you accept the change. We may suspend or end your access if you break these terms.

Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction, without affecting any mandatory consumer rights in your country of residence.
